Title
Consider adoption of Resolution No. 23-003 authorizing the General Manager or his designee to file and execute applications and funding agreements with the Metropolitan Transportation Commission (MTC) for AC Transit’s Fruitvale Corridor project.

Securing grant funds for this project will help the District in funding a vital capital project that will improve transit performance.
BUDGETARY/FISCAL IMPACT:
The District was awarded $2 million for the Fruitvale Corridor project for MTC’s One Bay Area Grant Cycle 3 (OBAG 3) Program through ACTC’s Comprehensive Investment Plan (CIP) in January 2023.
Per MTC guidelines, the District will need to provide a 11.47% local match. With the funding nomination of $2 million, the project’s total cost is an estimated $2.23 million. This project will be added to the District’s annual capital budget for FY 2024-26. The match will come from a combination of District capital or other grants.
BACKGROUND/RATIONALE:
On June 22, 2022, the Board approved five capital projects for submission to ACTC’s CIP program that also met MTC’s OBAG 3 funding criteria. On September 1, 2022, ACTC announced that out of the five capital projects that were submitted for consideration, only the Fruitvale Corridor project would be forwarded to MTC for consideration of OBAG 3 funding at a reduced amount of $2 million instead of the requested amount of $3.73 million due to lack of available funding. MTC announced OBAG3 awards on January 11, 2023.
The Fruitvale Corridor project would add Transit Signal Priority (TSP), a queue jump, signal communications and signal coordination improvements along Fruitvale Avenue and its vicinity The Project will improve operations of Lines 14, 20, 21, and 39. Staff will adjust the number of improvements to be added in this corridor to align with the available funding.
The District is required to submit a resolution to MTC to confirm the District’s acceptance of MTC funding for the project.
ADVANTAGES/DISADVANTAGES:
Staff cannot identify any major disadvantages to approving this report.
ALTERNATIVES ANALYSIS:
The District could choose not to accept funding from the MTC OBAG 3 program.
