There is no budgetary or fiscal impact associated with this report.

 

BACKGROUND/RATIONALE:

 

Board Policy 410 was adopted by resolution in 2013 and was last amended in 2017.  The policy serves as a supplementary document to the Bus Rapid Transit (BRT) Project Labor Agreement (PLA), which was designed to generate substantial employment and business opportunities. It accomplished this by implementing targeted hiring strategies focused on areas of high unemployment, and on individuals with barriers to employment.

 

These objectives were advanced by targeting the BRT Project’s construction employment and training opportunities in ways calculated to (1) mitigate the harms caused by geographically-concentrated poverty, (2) fight unemployment and underemployment in vulnerable populations and neighborhoods, including populations with barriers to employment, (3) advance the skills of targeted workers and enable workers to earn wages that would assist them in moving out of poverty, (4) provide links to career paths for targeted workers, and (5) facilitate rapid completion of the BRT Project. As a result, the proprietary interests of AC Transit were protected through negotiation and implementation of a project labor agreement that also assured labor peace on the BRT Project. Now that the Tempo service is operational, the requirements of the policy have been fulfilled and the policy is obsolete.

 

Staff recommends adoption of Resolution No. 23-013, repealing Board Policy 410 and Resolution Nos. 13-207 and 17-040.

 

ADVANTAGES/DISADVANTAGES:

 

The request to repeal Policy 410 and its enacting and amending resolutions serves as an opportunity to remove a policy that has been obsolete for over two years. There are no disadvantages to the course of action outlined in this report.

 

ALTERNATIVES ANALYSIS:

 

There are no alternatives to the course of action recommended in this report as the policy is obsolete.
