BACKGROUND/RATIONALE:

The Trust Agreement for the ATU Local 192 Retiree Health and Welfare Trust was approved by the Board of Directors on July 29, 1998, and became effective on July 1, 1998. As part of the agreement, a Board of Trustees, which currently consists of two Union Trustees and two Employer Trustees, was created to administer the trust.

Due to the planned retirement of the District's current trustee (Chief Financial Officer Claudia Allen), the General Manager is requesting that Chris Andrichak fill the upcoming vacancy on the Board of Trustees. If appointed,  Mr. Andrichak will serve at the pleasure of the AC Transit Board of Directors until a successor is appointed. Staff recommends that the Board approve the appointment.

ADVANTAGES/DISADVANTAGES:

Appointing Mr. Andrichak as an Employer Trustee to the Board of Trustees will help ensure that the conditions of the Trust Agreement are upheld from the standpoint of the Employer.

ALTERNATIVES ANALYSIS:

There are no practical alternatives to the course of action outlined in this report.
