BACKGROUND/RATIONALE:
Board Policy 110 was enacted in 1994 and has been periodically updated to reflect changes in process as well as changes in the law and Federal Transit Administration (FTA) Regulations/guidance. It recently came to the attention of the General Counsel that the policy contained language which required that a public hearing be held if emergency service changes were in effect longer than 12 months when there is no legal requirement, nor any applicable regulation or guidance imposed by the FTA. On these grounds, staff recommends that the Board approve a corrective amendment with regard to emergency service conditions as outlined in Attachment 1.
